A Court of Appeal sitting in Akure, the Ondo State capital, on
Wednesday, dismissed a suit filed by the dethroned Deji of Akure, Prince
Oluwadare Adesina, challenging his removal as the traditional ruler of
Akure.
The dethroned monarch had earlier approached the high court to challenge his removal where the case was thrown out for lack of merit.
Not satisfied with the decision of the lower court, Adesina approached the Appeal Court where the case was also struck out.
Counsel to the state government, Mr. Folahan Salami, had earlier argued that it was necessary for the claimant to seek leave of the court to appeal the decision of the lower court which had earlier heard the case.
According to him, the failure of the claimant, Prince Adesina, or his counsel to make necessary application to the lower court or the appeal court before filing his appeal amounted to a breach of the court's procedural process and as such, it was a hinderance to the court assuming jurisdiction on the the matter.
The trial judge, Justice Sotonye-Denton West, however, struck out the case for lacking merit.
It would be recalled that upon his dethronement and banishment to Owo in June, 2010, the deposed Deji approached an Akure High Court challenging his removal but the case was dismissed for lack of diligent prosecution in November, 2012
